TERMS AND CONDITIONS

Compassionate Care Private PSW Service — Ontario, Canada

By engaging the services of Compassionate Care Private PSW Service, the Client agrees to the following terms and conditions:

1. Liability Disclaimer

The Personal Support Worker (PSW) and Compassionate Care Private PSW Service are not liable for any injuries, damages, or losses that may occur during the provision of services. The Client understands and voluntarily assumes all risks associated with receiving personal support services.

2. Service Agreement Duration

This agreement will remain in effect from the start of service and continue until terminated by either party. Termination requires a minimum of two (2) weeks’ written notice.

 

In the event of a medical emergency or significant health-related change, the agreement may be terminated immediately.

3. Refund Policy

All payments made to Compassionate Care Private PSW Service are for services that have already been delivered. No refunds will be issued under any circumstances for completed services.

 

Clients are encouraged to review and confirm scheduled services in advance. If there are concerns regarding the care provided, please contact us to resolve the issue.

4. Confidentiality

The purpose of this agreement is to ensure the protection and confidentiality of sensitive client information.

Definition of Confidential Information:
"Confidential Information" includes, but is not limited to:

  • Personal health information of clients

  • Medical history and treatment plans

  • Any personal details, including identity, living situation, and family information

The Personal Support Worker agrees to:
a. Maintain the confidentiality of all Confidential Information and not disclose it to any unauthorized persons
b. Use Confidential Information solely for the purpose of providing care and support as authorized by the Client
c. Take all reasonable measures to protect the confidentiality of the information, in accordance with applicable privacy laws and regulations, including Ontario’s Personal Health Information Protection Act (PHIPA)

5. Client Consent

By using the services of Compassionate Care Private PSW Service, the Client acknowledges and agrees to these terms and conditions. The Client provides informed consent to receive personal support services and understands the nature, scope, and potential risks associated with such care. The Client agrees to disclose any relevant health or safety information necessary for the safe and effective delivery of services.

6. Insurance Disclosure

Compassionate Care Private PSW Service maintains appropriate professional liability insurance coverage. This coverage is in place to support both clients and staff during the provision of services. While every effort is made to ensure a safe environment, the Client acknowledges that certain risks are inherent in personal support care.

7. Code of Conduct

At Compassionate Care Private PSW Service, we are committed to upholding the highest standards of professionalism, safety, and respect in all interactions between staff and clients. This Code of Conduct outlines mutual expectations to ensure a safe and supportive care environment for everyone involved.

Client Responsibilities

Clients and their families agree to:

  • Treat all Personal Support Workers (PSWs) with respect and dignity

  • Provide a safe and hazard-free environment for in-home care

  • Refrain from any form of harassment, discrimination, or abusive behavior (verbal, physical, or emotional)

  • Notify the company of any changes to health conditions, medications, or safety concerns that may affect care delivery

  • Ensure pets are secured and smoking is avoided during service hours, in accordance with worker safety standards

  • Respect the privacy, boundaries, and working hours of PSWs

Failure to comply with these standards may result in suspension or termination of services to protect the safety and well-being of staff.

Staff Responsibilities

All PSWs employed by Compassionate Care Private PSW Service are expected to:

  • Provide compassionate, respectful, and client-centered care

  • Maintain professional boundaries at all times

  • Comply with all applicable laws, including the Personal Health Information Protection Act (PHIPA), the Occupational Health and Safety Act (OHSA), and other relevant standards of practice

  • Report any safety concerns, client incidents, or violations of this Code to management

  • Refuse unsafe work, in accordance with Ontario’s right-to-refuse provisions under OHSA

We are committed to maintaining a safe and respectful care environment for both clients and staff, and will investigate any violations of this Code promptly and professionally.

8. Scope of Services

Compassionate Care Private PSW Service provides non-medical personal support services in accordance with Ontario’s legislation, including the Home Care and Community Services Act, Regulated Health Professions Act (RHPA), and Personal Health Information Protection Act (PHIPA).

All services are delivered by certified Personal Support Workers (PSWs) trained to meet Ontario’s standards for home and community care. Our care is client-centered, respectful, and designed to support daily living while maintaining safety and dignity.

Our PSWs may provide the following services:

  • Assistance with personal hygiene, bathing, grooming, dressing, and toileting

  • Mobility support, including safe transfers and positioning

  • Meal preparation and feeding assistance based on dietary needs

  • Medication reminders (non-administration unless formally delegated by a Regulated Health Professional with appropriate documentation and training)

  • Light housekeeping to maintain a clean and safe living environment

  • Companionship, social interaction, and emotional support

  • Observation and prompt reporting of any changes in the client’s condition to a supervisor or designated healthcare provider

Emergency Protocol:
In the event of a medical emergency or life-threatening situation, PSWs are trained to call 911 immediately. They are not authorized to provide emergency medical care or make clinical decisions.

Important Clarification:
Our PSWs are not nurses, physicians, or therapists and do not perform any services that fall under regulated medical acts unless formally delegated by a healthcare professional. We do not provide clinical or diagnostic services.

PSWs DO NOT:

  • Administer injections or perform invasive procedures

  • Make medical assessments or decisions about treatment

  • Provide complex wound care, catheterization, or any service requiring nursing or physician-level skills

  • Undertake any controlled act unless under a formal delegation as per the RHPA

All services are guided by an agreed-upon care plan developed with the client and/or their legal representative. This care plan will be reviewed and updated regularly based on the client’s evolving needs or medical status.

All PSWs employed by Compassionate Care operate in strict adherence to PHIPA and maintain full client confidentiality and professional boundaries at all times.

9. Changes to Terms

Compassionate Care Private PSW Service reserves the right to update, revise, or modify these Terms and Conditions at any time. Clients will be notified of any material changes before they take effect. Continued use of services after such updates constitutes acceptance of the revised terms.

10. Credentials

Compassionate Care Private PSW Service is owned and operated by Farrah Kennedy, an Advanced Medical Personal Support Worker, and a verified Entrepreneurial Member of both the Ontario Personal Support Workers Association (OPSWA) and the Canadian Support Workers Association (CANSWA).

All Personal Support Workers employed by Compassionate Care Private PSW Service are certified professionals, trained in accordance with Ontario's standards for personal support work in home and community care settings. The company is recognized as a certified provider by OPSWA and CANSWA.

12. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts in Ontario.
